When a couple decides to separate due to an irresolvable differences and issues, divorce records are automatically generated. Sadly, it is greatly increasing in number. In California, the government has developed an online server which manages the divorce cases of the state. The Freedom of Information Act has allowed the residents of a given state to access their personal records including divorce records California generates.

The residents of California use divorce records for several purposes. Once the couple separates, their properties and assets have to be legally divided as well. This requires the divorce certificates as proof of their separation to have the division of properties processed. Also, when a divorcee plans to marry again, one of the requirements that have to be presented is the legal divorce paper otherwise; they may not be able to proceed with the marriage. The document is also one of the references used by individuals who wish to make sure that their partners are really single as they claim they were. Updating the family register also calls for a divorce certificate but it may be the least needed document. If the divorce is not updated on the family tree, it may cause a great problem for the later generations.

Divorce records in California may have controlled information on it. This means that not all the details of the separation are indicated on a public file. Only the name of the couple, the date and the place where it was made legal is available on the pubic file. Details such as the reason for the divorce are not found on the public file. The custody of the children and financial matters are also kept away from the public to respect the privacy of the couple.

Divorce which has been registered since 1962-1984 cost $13 per copy. The fee for the records after that may vary since it can only be obtained at the county where the couple separated. Divorce certificates are not released if the sworn statement of penalty or perjury is not signed on the application process. This started since July 1, 2003.

Unlike other state, the office of the Vital records Section does not release a copy of a divorce certificate. As mentioned earlier, it has to be requested at the county of separation. The state office can only assist with identifying the county where the couple separated. The request can also be done through a mail order however; one must ensure that all of the requirements are included on the mail. The sworn state of penalty and perjury has to be signed already. The Internet has opened a lot of possibilities for the development of our society. It is now used to deliver information to the public including California divorce records. It has eliminated the need to go to the office to file the request since it can be done even at home and the needed information is displayed right away instead of waiting for several days.
