When Divorcing In Michigan Get An Attorney

By Benjamin Rourke

In doing some research on divorce attorneys here in Southgate, Michigan, I came across some interesting information. I saw statistics in the trade news that stated there are about 6500 divorces a year in Wayne county alone. That's a lot of separations, child custody cases, and divorces, happening here in this area.

Well, anyways I discovered the first thing a divorce attorney should try to focus in on is, are there children involved in this divorce or not? Because there's a big difference.

The divorce courts in Michigan are set up so that there is a waiting period of six months, a cooling off period if you will if the couple have minor aged children. If you are a couple that is childless then this isn't a problem the waiting period is only 60 days. Your lawyer and I'm talking about a lawyer here in Michigan or any state for that matter will know if this applies or not. This has to be one of the first things your attorney focuses on taking your case.

The next thing that your lawyer should focus in on is the length of the marriage. Is it a short term marriage or is it a long term marriage. And those words don't have any precise meaning, but in my mind, in most judges minds it would probably be 8, 9, 10 years that it would be considered a long term marriage. And why that's important is if there's a disparity in income in a long term marriage, then you're probably entitled to spousal support. A lot of people say oh I didn't know you can still get that. Does Michigan allow that? Of course they do. It's called spousal support or alimony. It's the same word basically. So, yes, so I definitely want to know is there a possibility of one party or the other side getting spousal support.

Another element that comes into play is the property the family lives in another property that is owned by the couple. This can throw a monkey wrench in a divorce and make it more difficult. Especially when the economy which is tanked for so long sees most homes value decline. Who was out and who stays or who keeps the house can be touchy. So what's the best way to handle it is important in any divorce proceeding. One thing to keep in mind is that the financial institution that holds your mortgage, may be willing to accept the property and take it off your hands.

Just judging from the subjects written about, it comes without saying that hiring an experienced divorce attorney is the best way go. I was surprised to find a that some try to do it without an attorney. That's not wise, but that's another story for another time. []
